A UTU 2008 Contract Informational Meeting will be held to discuss the National Contract. The meeting will be held April 11, 2008 (Fri), 1:00 pm at the Doubletree Hotel, 222 North Vineyard Ave, Ontario (909-937-0900)./


UTU Vice President John Previsich and General Committee officer(s) from this committee will be in attendance to answer questions.

REPOSITIONING ONE ON THE POOLS IS NO LONGER ALLOWED. THIS WAS AN AGREEMENT PROVISION THAT EXISTED FOR YEARS THAT ALLOWED THIS AND WORKED FAIRLY WELL AT THE TIME. UNFORTUNATELY, THERE WAS SO MUCH ABUSE OF THIS PRIVILEGE IN THE LAST COUPLE OF YEARS THAT IT WAS CHANGED TO PROTECT AGAINST THE ABUSERS. YOUR TIE- UP TIME DETERMINES YOUR PLACEMENT ON ALL POOLS AT WEST COLTON, PERIOD. PLEASE COMPLY.

AS OF WED. AUG. 1st. THE FLAT RATE TO YERMO IS GONE. THE MILEAGE BASED ON THE PREVIOUS FOUR WEEKS AT 130 MILE PER START CALLS FOR 10 TURNS, SO MONDAY I WILL BE CUTTING 8 TURNS. UP11 THRU UP18.

RULE 81.5.4
 
The Carrier is taking exception to Locomotive Engineers who leave the confines of their locomotive cab when ground crew members are working on or between equipment, in those situations commonly referred to as ?Red Zone?. At least two disciplinary actions have been initiated on the Portland Service Unit in the past few weeks for this alleged infraction. In both cases, the Charged Employees were at UPGRADE Level Three prior to the alleged infraction, and the Carrier?s discipline is assessed at UPGRADE Level Four. The rule requires a crew member to remain in the locomotive cab when another ground crew member has requested and received permission from the Locomotive Engineer to work on or between equipment. The Carrier is interpreting this rule to include locomotives that are being picked up or set out.
 
We recommends the following course of action:
 
?      Conduct a thorough job briefing prior commencing any task that demands any member of the crew to work on or between equipment. Have a clear understanding of what work will be done, and who will be performing that work, and any special consideration that need to be taken into account. Annotate your job briefing booklet with the date and time and a brief description of what was covered prior to commencing the task.
 
?      When a ground crew member has requested permission to work on or between rolling stock (cars, maintenance-of-way equipment, etc.), center and remove your direction control handle, and fully apply your independent brake. DO NOT LEAVE THE LOCOMOTIVE CAB FOR ANY REASON.
 
?      When picking-up or setting-out locomotives, have a clear understanding of who will be handling MU hoses and cables, and safety chains. When it becomes necessary for you to exit the locomotive cab to restore or nullify operating controls on trailing locomotives, ensure that all connections of these appurtenances have been handled properly, or perform a locomotive daily inspection; require your conductor (or other crew member) to remain in the cab while you are not present. If your conductor is not present when it becomes necessary for you to accomplish these tasks, secure your locomotives pursuant to Rule 32.1.3 (Unattended Locomotives) prior to initiating this work. UNDER NO CIRCUMSTANCES ALLOW YOUR CONDUCTOR OR OTHER CREW MEMBER TO BE ON OR BETWEEN EQUIPMENT UNLESS YOU OR ANOTHER CREW MEMBER IS IN THE CAB.

100% rules compliance is demanded. Any deviation from the Carrier?s interpretation of the rules will be handled with formal discipline. Coaching, counseling and/or remedial training is not an option.
 
 
 
Protect your job and your family?s financial well-being. Take the advice of the Carrier and read your rule book on a daily basis. The Carrier expects 100% rules compliance from you; endeavor to accommodate their expectations.

SHOW ALL MOVEMENTS IN YOUR FRA SCREEN IF YOU WANT TO GET PAID. THEY MAY DENY YOUR CLAIM BUT DON?T BE DISCOURAGED. CALL THE SHORTAGE CLERK AND IF THEY DENY IT AGAIN, THEN TURN IT INTO ME WITH A COPY OF YOUR DENIAL.


THIS ALSO GENERATES A CLAIM FOR THE EXTRA BOARD EVERY TIME IT?S DONE, SO TURNING THESE CLAIMS IN IS IMPORTANT. EVERYDAY THERE ARE HELPERS PATCHING TRAINS AND EVERY DAY THERE SHOULD BE AN EQUAL AMOUNT OF XT10 CONDUCTORS AND XE10 ENGINEERS GETTING THOSE CLAIMS.


REMEMBER THIS!


ALL PENALTY CLAIMS PAID TO EXTRA BOARD CONDUCTORS ARE IN ADDITION TO THE GUARANTEE!!!


THIS MONTH ALONE, I HAVE PROCESSED $8,676.00 IN CLAIMS FOR THE FIRST OUT EXTRA BOARD CONDUCTORS WHO STOOD FOR PATCH SERVICE!!


MY GOAL IS TO TAKE $50,000.00 IN CLAIMS TO THE NEXT EXPEDITED ARBITRATION AND MAKE THE COMPANY PAY FOR THEIR ARROGANCE.

ATTENTION EXTRA BOARD TRAINMEN


IF YOU WORK A HELPER AND YOU PATCH A TRAIN YOU ARE PERFOMING COMBINATION SERVICE. YOU ARE ENTITLED TO THE HIGHEST RATE OF PAY FOR THE SERVICE PERFORMED. IF YOU HAVE A LOT OF OVERTIME YOU MIGHT MAKE MORE MONEY BY CLAIMING IT RATHER THAN COMBO SERVICE. EITHER WAY YOU NEED TO FILL OUT THE FRA AND SHOW PATCHING THE TRAIN SO I CAN GENERATE A CLAIM FOR THE EXTRA BOARD.


Art. 39 Sec. A.1 Trainmen who perform two or more classes of service at an intermediate point or points between the terminals of their assignment or run will be paid for the entire tour of duty at the highest rate applicable to any class of service performed.


FILL OUT YOUR CLAIM LIKE THIS


USED OFF HELPER TURN [TURN#] IN COMBINED SERVICE TO PATCH THE [TRAIN] AT [LOCATION] AND TAKE IT TO COLTON. ART. 39 SEC. A.1 STATES THAT I AM ENTITLED TO THE HIGHEST RATE OF PAY FOR THE SERVICE PERFORMED. CLAIM A YUMA TRIP RATE IN ACCORDANCE WITH THE 2002 NATIONAL AGREEMENT.

IF YOU ARE WORKING IN POOL FREIGHT AND YOU ARE TOLD TO PULL OR SPOT THE AUTO FACILITY AT MIRA LOMA I WANT YOU TO CLAIM A 100 MILES AT THE ROAD SWITCHER RATE OF PAY. THAT MEANS IF YOU GO OVER THE BRIDGE AND INTO THE SUPPORT TRACKS LIKE WE'VE BEEN DOING SINCE THEY PULLED OFF THE 47 AND 49 JOB. THEY WILL PROBABLY BE DENIED BUT I BELIEVE THEY ARE GOOD CLAIMS AND WE SHOULD LET AN ARBITRATOR DECIDE DOWN THE ROAD. BELOW IS AN EXAMPLE OF HOW TO CLAIM IT AND REMEMBER, IF THEY DENY IT YOU NEED TO PUT A COPY IN THE BOX SO I'LL KNOW AND CAN APPEAL IT TO OMAHA.
